Allegation
Police pulled over client after running a check on the license plate and finding he had an outstanding warrant for assault. The warrant contained predetermined bond conditions, one of which prohibited client from possessing a firearm. Police arrested client on the outstanding assault warrant and charged him with violating bond conditions since he had a gun in the vehicle.
Key to Success
Client was charged with violating an assault bond condition even though he was not yet on bond for the alleged assault. We proved client had no knowledge of the assault warrant nor its bond conditions at the time of his arrest. Without knowledge, it was impossible for client to have knowingly violated a bond condition. We threatened to go to trial, and since prosecutors could not prove the required mental state, they dismissed the case prior to trial.
